Win a Podium iPhone stand…and perhaps a visit from Apple’s lawyers

Apple legal has officially gone insane. Pivotal, makers of the Podium iPhone stand, received a cease and desist letter last week from Townsend and Townsend and Crew LLP (not to be confused with J. and Crew or 2 and Live and Crew) on behalf of Apple regarding Pivotal’s use of the name Podium. Apple, it seems, feels the “Pod” of “Podium” is a direct reference to the iPod, and is therefore infringing upon their trademark rights. And hey, guess what we’re giving away again this week!
The cease and desist actually targets both the Podium and Flypod products from Pivotal, because, you know, “...Apple has a duty to protect its consumers and its valuable intellectual property,” as it says in the letter. Isn’t that just so cute the way they say that, protecting us consumers? I feel safer. You?
“If you look at our product and then look up the word Podium in the dictionary, I think it becomes pretty clear where our branding inspiration came from,” stated Scott Baumann, president of Pivotal. “We were certainly surprised by the allegations and will be consulting with our legal counsel regarding this matter.”
I’d like to think Apple will just be laughed out of the courtroom on this one, but my complete and total lack of faith in the U.S. judicial system leads me to believe this won’t be so. Therefore, you’d better get ahold of your Podium now before it’s redubbed “Stand that Displays Particular Cellular Device of Telephonic Purpose/Construction.” We gave one away last week to Appletell reader Jonah Grant, and we’ve got another ready for this week. Frankly I don’t see why Apple would ban a third party product that ultimately it’s designed with the sole purpose of holding iPods or iPhones, it’s like free publicity, but then again I might be wrong or this world has just gone nuts
